TextWay Privacy Policy

Account Information: When you create an account, we collect your name, email address, company or organization name, and billing information.

Contact & Recipient Data: You may upload or input phone numbers, names, and other details about the people you message. You are responsible for obtaining any consent required to share that information with us.

Message Content: We process the content of messages you send and receive through the Service in order to deliver, log, and display them within your account.

Usage Data: We automatically collect information about how you interact with the Service, including log data, IP addresses, browser type, pages viewed, and feature usage.

Carrier Integration Data: TextWay uses Telnyx as its SMS/MMS carrier. We operate messaging through TextWay-managed Telnyx infrastructure and do not require you to supply your own carrier credentials.

We use the information we collect to:

• Provide, operate, and improve the Service
• Send and receive SMS/MMS messages on your behalf
• Process billing and manage your subscription
• Respond to support requests and communicate with you about your account
• Monitor for security threats, abuse, and compliance with our Terms of Service
• Comply with legal obligations

We do not sell your personal information or your contacts' personal information to third parties.

TextWay offers optional AI-powered auto-reply features. When enabled for a group, incoming message content may be processed by a third-party AI model (such as OpenAI) solely to generate a contextually relevant reply. We do not use your message content to train AI models.

Help Center questions and AI generated answers may be retained and reviewed internally to improve support quality and product guidance. These logs are accessible only to TextWay administrators and are not sold to third parties.

We may share information with:

• Application Platform (Base44): Base44 is our application platform and hosting provider, used for authentication, database storage, backend functions, and application hosting. Base44 processes your account information, contact and recipient data, message content, billing records, and related application data on TextWay's behalf as needed to operate the Service.
• Service Providers: Trusted vendors who help us operate the Service (e.g., Telnyx for SMS/MMS delivery, payment processors for billing). These parties are contractually required to protect your data.
• Legal Requirements: We may disclose information if required by law, regulation, legal process, or governmental request.
• Business Transfers: If TextWay is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

TextWay uses Google Ads and the Google tag to measure whether visits from our advertising lead to signups or purchases and to help us understand how our campaigns perform. The Google tag is a small piece of code provided by Google that is loaded on our pages and may send Google the page URL, certain device and browser information (such as browser type and approximate region), ad-interaction identifiers (such as a Google click identifier when you arrive from an ad), and cookie or similar-technology data. Google processes this information under its own privacy practices, and we do not receive personal data from Google through this tag beyond aggregated campaign performance reporting.

This disclosure relates only to advertising measurement and campaign performance. TextWay does not sell your personal information.

You are responsible for ensuring that the individuals you contact through TextWay have given you any required consent to receive messages and to have their information processed by a third-party platform like TextWay. You must maintain appropriate opt-out mechanisms and honor opt-out requests promptly.

We retain your account data and message history for as long as your account is active or as needed to provide the Service. You may delete your account and associated data by contacting us. We may retain certain information longer as required by law or for legitimate business purposes.

We implement industry-standard technical and organizational measures to protect your information against unauthorized access, loss, or misuse. However, no system is completely secure, and we cannot guarantee the absolute security of your data.

We use cookies and similar technologies to keep you logged in, remember your preferences, and understand how the Service is used. You can configure your browser to refuse cookies, though some features of the Service may not function properly as a result.

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties and encourage you to review their privacy policies.

The Service is not directed to children under the age of 18, and we do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, please contact us and we will promptly delete it.

TextWay will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing the services of that campaign. TextWay may share personal data, including SMS opt-in or consent status, with service providers that help provide messaging services, including telecommunications carriers, messaging infrastructure providers, platform providers, and technical vendors. Mobile information and SMS opt-in consent will not be sold or shared with third parties for promotional or marketing purposes.
